After the Event insurance is a method of assisting the funding of
most types of litigation by transferring the risk of any resultant
costs liabilities from a claimant to an insurer. Such costs
could include disbursements and defendant costs.The policy is purchased after the cause of a legal dispute,
therefore given the name ‘After the Event’ Insurance.In most cases, the premium for After the Event insurance
can be recovered from the defendant in the litigation as
a standard disbursement. With most insurers, payment of
the premium can be deferred until the end of the case.
To further minimise the risk to the claimant, the premium
can often be ‘self-insured’, meaning the policy will pay for
its own premium should the litigation fail.After the Event insurance is available on most types of
litigation from personal injury requiring lower limits of
indemnity through to high value and complex litigation
where seven figure legal costs are common.
In recent years, most of the available ATE (After the Event) Insurance products on delegated authority schemes appeared similar on the surface. However, the streamlining of the RTA claims process in April 2010 has led to much more diversity in the range of schemes on offer for this particular type of case.

Ongoing monitoring and assessment of your whole ATE scheme ensures that Independent ATE can give you advice if we see that an alternate product would be more beneficial. If, following this advice, you do decide to change your scheme, the Independent ATE portal will process any necessary amendments, removing the need to change your internal processes.

We offer a range of options if you wish to apply for ATE insurance on cases that cannot be covered under a delegated authority scheme. Such cases could include commercial or civil litigation, professional negligence claims or insolvency litigation to name but a few. We are confident that whatever risk your client faces, we can find a way of insuring it.
With or without a delegated authority scheme, you can use our online system to complete an individual case proposal form, upload any supporting documentation and submit it to us for assessment and quotation. This enables Independent ATE to search the market and obtain quotations and eliminates the need for you to complete multiple proposal forms to submit to multiple insurers in order to find your clients best option.
We also accept written proposal forms and can supply these upon request.
Quotations will come from a range of insurance companies and each will usually also offer a range of alternatives. We will offer our advice on which option best meets the requirements of your client and will always be available to discuss them.
